Terms and Conditions

PRELIMINARY AGREEMENT TERMS AND CONDITIONS:

A:         This tender is subject to the Clients & the Builder entering into an acceptable written contract.

            There is no contract until both parties sign the Master Builders “Residential Building Contract” on terms acceptable to both parties.

B:         This tender is subject to the Clients providing satisfactory evidence, satisfactory to the Builder, of his/their capacity to meet the financial commitments of the contract.

C:        This tender is based on a construction period of 152 working days plus public holidays plus a reasonable allowance for wet weather delays from the date of receipt of all approvals including all selections. Kenick Constructions reserve the right to claim an extension of time for unforeseeable delays due to the unavailability of materials and or Sub-contractors over and above the allowance noted above.

D:        This tender is subject to receipt of all approvals and selections and being able to commence construction within 60 days of tender date.

E:         No allowance has been made for possible additional costs arising from;

1)    -  Unforeseen or unusual conditions imposed by Local Authorities.

2)    -  Rock or other unsuitable soil conditions not apparent before the works commenced.

3)    -  Conditions made apparent by any authorized soil test carried out after the above date.

4)    -  Existing services on site i.e. sewer mains, water mains, storm water lines etc.          

F:         Earthworks/site costs noted as a P.S. (Provisional Sum) allowance shall include all earthworks, engineering costs, compaction tests & all associated material & machinery costs.

G:        Any furniture, appliances (refrigerators, freezers, washing machines, microwave ovens or any other items shown on the drawings are illustrated for positioning purposed only and are not included in this tender price unless specifically noted in the attached “Specification & Finishes Schedule (Schedule B).

H:        No allowance has been made for the replacement of missing boundary pegs.

I:          No provision for hill slopes or bush fire requirements.


SCHEDULE B (SPECIFICATIONS & INCLUSIONS) WARNING:

On occasion, it may be necessary to substitute items included in this document with an alternative (e.g. when new models replace appliances which may be listed, if there are supply hold up’s with items/materials, or our sub-contractors amend their supply chain to a comparable product).  In such cases, whilst we as principle contractor will endeavour to notify you where we are aware of the changes, it is sometimes not possible to do so.  However, any changes made which affect either aesthetics or performance in use (performance criteria), would of course be notified to you for your approval.

SCHEDULE A 

The Schedule A is an estimate quote only unless otherwise written. Prices may change depending on factors included in the preliminary agreement and:

  • Industry/Supplies price increases
  • Council and legislative requirements
  • Client approved changes
  • Latent conditions

PLANS, DRAWINGS AND ARTWORK:

All plans, drawings, designs & artwork shall remain the absolute property of KNCB Pty Ltd. Under no circumstances shall this material be copied, duplicated or recreated without written consent from KNCB Pty Ltd.


MAINTAINING YOUR NEW HOME:

As a new home owner,you are required to maintain your home in accordance with the documents provided in your Building Contract. It is recommended that you read and follow the guidelines set out in the CSIRO Foundation Maintenance Guide. If you fail to follow the recommendations set out in this guide, you may void your 6 year structural guarantee.


LEGAL ADVICE: 

Kenick Constructions encourages all clients to seek independent legal advice before entering into a building contract. 


HOUSE AND LAND PACKAGES:

All prices listed on any house and land package are valid at the time of print and are subject to change at any time. A full list of inclusions will be provided along with the package or can be downloaded here.

SOIL AND WIND CLASS: Prices listed on any package, unless stated otherwise are based on a block of land with S class soil and C1 wind rating. There may be a price increase for lots with a M or P class soil, as too C2 or C3 wind rating.

FACADE: Unless otherwise written, all house and land packages are advertised with a 'Traditional' facade type and include standard inclusions. Upgrade options are available upon request.

If a particular package is no longer available, Kenick Constructions will do its utmost to remove this package from the market. If in doubt, contact the Sales Team on 0414 725 573 to confirm.
